Welcome to PayLater. These Terms of Service (“Terms”) apply to www.paylatergov.com and any related sites or applications (collectively, the “Site”), as well as your use of our loan services (“Services”). By accessing or using our Site or Services, you agree to these Terms. Please read them carefully. If you do not agree, please do not use PayLater.
1. Use of the Site and Services
Eligibility: You must be 18 years or older and a resident of the United States (currently, Texas only for loan services) to use PayLater. You agree to provide accurate information about yourself and to use our Site and Services only for their intended lawful purpose (e.g., obtaining a loan to pay a bona fide municipal fine). You will not use the Site in any way that violates any laws or regulations.
User Account: Some features require creating an account. You are responsible for keeping your login credentials confidential. Notify us immediately at support@paylatergov .com if you suspect unauthorized use of your account. You are responsible for all activities under your account.
2. Loan Agreement and Disclosures
Not an Offer/Commitment: Any approval odds or “pre-qualified” messages on the Site are not a guarantee of loan approval. A loan is only consummated when you sign a separate loan agreement. The terms of that loan (amount, interest rate, repayment schedule) will be governed by the loan agreement and federal disclosures (Truth in Lending Act) provided to you. These Terms of Service govern your use of the website and general services, not the specific lending terms (which you’ll see in the loan contract).
Accuracy of Information: You certify that all information you provide in your loan application (and on the Site generally) is truthful and accurate to the best of your knowledge. Submitting false information can result in denial of Services or legal action if fraudulent.
No Financial Advice: PayLater does not provide legal, financial, or tax advice. We offer lending options for you to consider at your own discretion. If you’re not sure whether taking a loan to pay a fine is right for you, consider seeking advice from a financial counselor. By using our service, you acknowledge that you are responsible for understanding the consequences of any loan you take.
3. Website Content and Intellectual Property
All content on the Site (text, logos, graphics, images, software) is the property of PayLater, LLC or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission. License to You: PayLater grants you a limited, revocable license to use the Site for personal use (for applying and managing your loan). You agree not to misuse our Site (such as hacking, data mining, or infringing on our IP).
4. Prohibited Conduct
You agree not to: - use the Site for any fraudulent or unauthorized purpose; - interfere with or disrupt the Site’s functionality or security; - attempt to access other users’ data or PayLater’s backend systems; - use any automated means (robots, scrapers) to collect content or information from the Site without our permission.
Violation of these rules may result in termination of your access to the Site and potential legal action.
5. Privacy
Your use of the Site is also governed by our Privacy Policy. We encourage you to read it to understand how we collect and handle your information. By using PayLater, you consent to our collection and use of data as outlined there. If there is a conflict between the Privacy Policy and these Terms regarding personal data, the Privacy Policy governs.
6. Disclaimers
Service “AS-IS”: PayLater strives to provide accurate, secure, and reliable Services, but we do not guarantee that the Site will be error-free or uninterrupted. The Site is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. For example, we don’t guarantee that applying will result in an approval, or that using our Site will prevent any consequences from your original fine (you must still pay the fine on time).
Third-Party Links: Our Site might contain links to third-party websites (for example, a link to a city payment portal or an educational article on traffic fines). These are provided for convenience. We do not endorse or assume responsibility for any third-party sites or content.
7. Limitation of Liability
To the fullest extent permitted by law, PayLater, LLC and its officers, directors, employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Site or Services. Our total liability for any claim arising from or related to the Site or Services is limited to the amount of fees we have earned from you through the Services (which, for a typical user, may be the interest paid – if no loan was taken, then $0).
This means we are not liable for things like: losses due to your use of the loan (e.g., if paying a fine saves you from a warrant, great, but if something else happens, that’s beyond our scope), or if our Site was unavailable and that somehow caused you inconvenience. However, none of this affects any rights you might have under consumer protection laws or the ability to dispute issues with your actual loan (which is governed by your loan agreement).
8. Indemnification
You agree to indemnify and hold harmless PayLater and its affiliates from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or rights of a third party. In simple terms, if you do something illegal or violate our agreement and that causes us to be sued or incur costs, you’ll cover those costs.
9. Changes to Terms
We may update these Terms from time to time. If changes are significant, we will notify users via email or a prominent notice on the Site. The “Last Updated” date at the top will always indicate when the last changes were made. By continuing to use the Site after updates, you accept the new Terms. If you do not agree with any changes, you should stop using the Site and Services.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas (without regard to its conflicts of law principles). Any disputes that arise will be resolved in accordance with the loan agreement’s dispute resolution (for loan-specific issues) or by courts in the State of Texas for general contractual issues, unless otherwise required by law. We may include an arbitration clause in the loan agreement itself for loan disputes; if so, that will be disclosed in that contract.

12. Equal Credit Opportunity Act Notice:
The Federal Equal Credit Opportunity Act (ECOA) prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age, or because all or part of an applicant's income comes from public assistance, or because an applicant has in good faith exercised any right under the Consumer Credit Protection Act. PayLater complies with ECOA. If you believe you have been discriminated against, you can contact the Consumer Financial Protection Bureau or Texas OCCC. You will receive a notice of adverse action with specific reasons if your application is denied or counter-offered, per law.
